Antitrust and Unfair Trade Practices

Kinney Ellinghausen provides antitrust counseling for clients large and small from a variety of industries. Representing both plaintiffs and defendants, we are experienced in anti-trust litigation, and we handle "business tort" cases such as those involving allegations of unfair trade practices.

Appellate Practice

Whether preserving a successful result obtained by our firm in the trial court, or taking over as counsel on appeal, Kinney Ellinghausen draws on vast procedural knowledge when handling appellate matters. After careful and exhaustive legal research, our attorneys develop logically compelling arguments. We take pride in crafting concise, effective legal briefs that provide our clients with the very best chance of success at the appellate level.

Closely Held and Family Businesses

Our firm offers closely-held and family businesses a wide array of services, including advice on incorporation, permitting, lease negotiations and all other legal matters that confront Louisiana business owners. With an understanding of the unique needs of family businesses, we also work with family members and non-family executives on management succession and ownership and control structures.

Commercial/Corporate Litigation

Kinney Ellinghausen has experience prosecuting and defending many types of corporate and commercial litigation, including derivative actions, officer and director liability, contract disputes and non- compete agreements. As with all of our litigation matters, our attorneys professionally and aggressively represent clients in an effort to obtain the best possible legal outcome. While we have resolved many disputes through negotiation, other battles have been won in the courtroom, but in all cases we act in the best interest of the client.

Employment Law

Kinney Ellinghausen has investigated claims and represented a number of employers in litigation involving allegations of discrimination based upon race, sex and disability. We have argued before the Equal Employment Opportunity Commission and in federal courts. Our firm can also provide advice on how to establish policies and procedures that may minimize a business's exposure to discrimination claims. This counsel is designed to reduce conflict in the workplace and resolve issues prior to litigation.

Environmental Law and Historic Preservation

Kinney Ellinghausen is regarded as a national leader in the practice areas of environmental law and historic preservation. We have represented developers and government entities on many occasions to ensure compliance with the National Historic Preservation Act and the National Environmental Policy Act, as well as in defending suits brought pursuant to those statutes.

The firm's proven track record of success in this area is exemplified by cases such as Coliseum Square Ass'n v. Jackson, et al, 465 F.3d 215 (5th Cir. 2006).

Governmental Agencies and Public Entities

Kinney Ellinghausen has its foundation in the representation of governmental agencies and public entities and has done so for some forty years. We currently represent local and state agencies including the State of Louisiana in selected matters. We have extensive experience in the unique areas important to government agencies, including public procurement issues, ethics issues, public records compliance, open meeting compliance and public employment cases. The firm has not only counseled agencies on these issues but successfully litigated in these areas. We have been active in helping agencies adopt top to bottom procurement processes to insure that there is no favoritism in the awarding of contracts and to make sure that the agency is receiving the lowest bid available. We strive to make public procurement an asset and not a burden to the agency. The firm recognizes that the functioning of government is vastly different than private enterprise.

Kinney Ellinghausen represents personal and business clients in many types of insurance cases, including denials of coverage, insurance exclusions, and bad faith. We have also successfully represented the interests of several insurance companies.

Kinney Ellinghausen also represents clients in their efforts to obtain local, state and federal government contracts. We have helped businesses navigate the bidding process, and we have appeared before state and federal courts in handling these claims.

Two of the firm's partners are admitted to practice in the U.S. Court of Federal Claims in Washington D.C. and the U.S. Court of Appeals for the Federal Circuit.
